How Do I Challenge A Refusal To Give Listed Building Consent To Demolish An Outside Toilet?

We applied for consent to knock down an unsightly outside loo which is slap bang in the middle of the garden our 17th Century farmhouse. Even though the outbuilding was not constructed at hte time of the farmhouse and doesn’t appear on an 1850 map, our council has deemed it ‘of historic value’. We want to challenge this and, if necessary, employ a law firm specialising in this sort of thing. Anyone know how or got any recommendations of where we might turn?

    If all else fails, you could try planting things to cover it over and with any luck some of the roots would undermine it and render it a dangerous structure which would have to come down.

  2. The document stating the refusal should have the method of appeal written on it, probably in small print. If it doesn’t the council should be taken to task on this point as well. If you don’t get a satisfactory response from the council contact the Local Government Ombudsman who will kick them up the jacksie.

    HYPOTHETICALLY SPEAKING…
    Sometimes cigarettes will catch old wood on fire. While an accident like this would be unfortunate, it wouldn’t be illegal as long as no insurance claim was filed to replace the property. Since you obviously don’t use the outhouse, you might want to think about storing shredded newspaper in it. But please don’t smoke around the outhouse if you put shredded newspaper in it!!!

    Here is my advice, build a fire close by and accidentally burn it down. then clean up the rubble.
